TERMS OF USE The following are the legal terms and conditions of an Agreement between you and Cookbooktree.com. By using or browsing this site, you acknowledge that you have read, understood, and agree to be bound by these terms and that you agree to comply with all applicable laws and regulations. If you do not agree to these terms, do not use this site. We reserve the right to modify these terms from time to time so you should use read these terms regularly. Purpose and Use of Site: This site was created to facilitate the sharing of recipes and the creation of cookbooks for recreational purposes, and for sale and distribution. By creating an account and/or posting a recipe and/or creating a cookbook on the Cookbooktree.com website, you are hereby consenting to the viewing of those cookbooks or recipes by the general public, if a public cookbook, or by the members of your cookbook, if a private cookbook. In the event that you are posting to a cookbook designated as private, you hereby notified that said recipe may at any time by edited to be available for public viewing by the editor of said cookbook. If you have reservations about your recipe being available for viewing by the general public, you should not post your recipe to this site. Correspondingly, any recipe posted to a cookbook that is currently public may, at any time, be edited by the editor of the cookbook to be private. All recipes posted and cookbooks created on the Cookbooktree.com website shall remain the property of the recipe author, but by using this site, you hereby consent to a irrevocable license of your recipe in perpetuity to other viewers and users of Cookbooktree.com to whom they may be or become available, regardless of whether or not you receive any remuneration for the particular recipe or cookbook(s) in which the recipe appears. For information submitted on behalf of third parties, you hereby certify and warrant that the author of all content, recipes, notes and anecdotes posted to any cookbook on Cookbooktree.com has directly granted to you the right to use the material with full knowledge of the purpose and scope of the use and with the knowledge that it could be available for viewing by the general public. By signing up for an account at Cookbooktree.com, you hereby agree that you will, at your own expense, hold harmless and defend Cookbooktree.com for any claim of breach or claim for trademark or copyright infringement in violation of this Agreement. Cookbooktree.com reserves the right to refuse to provide services to anyone wishing to create a website or other media material for a purpose deemed to be obscene, threatening, pornographic, or in any other way may be deemed to be offensive. This determination shall be made at the sole discretion of Cookbooktree.com. If Cookbooktree.com exercises this right, we shall provide, as soon as practicable, an explanation of our decision. Tax Liability: If you create a cookbook and you elect to offer it for sale, you hereby grant to Cookbooktree.com a license to sell the cookbook via the website Cookbooktree.com on your behalf. Cookbooktree.com will collect the funds from the purchaser and pay to you a Royalty based on the Royalty fee selected by you when setting up your cookbook. The Royalty fee shall be per cookbook. As Cookbooktree.com will be offering all cookbooks for sale and collecting said fees, Cookbooktree.com will collect all required sales tax from the purchaser, based on the location of the Cookbooktree.com headquarters and the location of the buyer. You will not be responsible for the collection and payment of sales taxes for the sale of your cookbooks. However, because you will receive Royalty fee income from the sale of each cookbook, Cookbooktree.com shall provide and send to you all appropriate tax forms to represent the Royalty income received on an annual basis according to the laws and regulations promulgated by the Internal Revenue Service. Intellectual Property Rights: All content, including but not limited to trademarks and taglines identifying us or our affiliates, graphics, images, photos, videos, content, button icons, and service names are solely our property, that of our operating companies or others. All content on this site is protected by national and international copyright laws and treaties. Nothing on this site should be construed as granting a license or right to use any trademark or copyrighted material displayed on this site, without the written permission of the owner of said trademark or copyrighted material. Other than browsing and using this site for its intended purpose, you may not in any way duplicate, distribute, modify, remove, delete, add to, publish, transmit, or in any way exploit any of the content of this site, in part or in whole, except when expressly authorized in writing by us.
